Dampak Judi Online (Judol) terhadap Pemenuhan Hak Anak dalam Perspektif Kompilasi Hukum Islam (KHI): Analisis Putusan Pengadilan Agama dan Kajian Normatif

Abstract

Online gambling has emerged as a social crisis that potentially threatens the resilience of Muslim families in Indonesia, particularly in the fulfilment of children’s basic rights. Prior studies have extensively examined the impact of online gambling on household harmony in general, yet analyses specifically addressing its relationship with three dimensions of children’s rights maintenance (nafkah), custody (hadhanah), and education within the framework of the Indonesian Compilation of Islamic Law (KHI) remain limited. This study aims to analyze the pattern of association between online gambling addiction and the neglect of these three rights. The study employs a descriptive qualitative approach with a normative-juridical method grounded in library research, supported by a limited content analysis of three 2024 Religious Court rulings that explicitly cite online gambling as part of the case facts. Findings indicate a consistent pattern linking gambling addiction to three forms of neglect: maintenance neglect due to diversion of household income, diminished custodial quality due to parental physical and emotional absence, and threats to children’s educational rights from both financial and supervisory perspectives. This study emphasizes that the pattern identified is indicative, based on a limited case sample, rather than a statistical generalization, and calls for further research with larger judicial samples and direct field data.
