Peta Kajian Hukum Ekonomi Syariah pada Program Studi Magister Hukum Ekonomi Syariah (MHES)

Abstract

This study aims to map the development and relevance of the research objects in the theses of students of the Master of Sharia Economic Law (MHES) Program in relation to the existing curriculum. Based on an analysis of 131 theses published between 2014 and 2024, it was found that students’ research focuses are highly diverse and reflect the dynamic development of the field of Sharia economic law. The most dominant research themes include the implementation of fiqh muamalah, DSN-MUI fatwas, and OJK regulations in Islamic banking products; the application of law in Islamic insurance; zakat and waqf management; institutional studies of cooperatives and Baitul Maal wat Tamwil (BMT); and studies of non-bank Islamic financial institutions such as the Islamic capital market, leasing, fintech, and Islamic pawnshops. In addition, several studies examine hajj fund management, halal product assurance, judicial decisions in Sharia economic disputes, the economic thoughts of prominent Islamic scholars, and various contemporary issues such as bankruptcy, mergers, digital transactions, customer data protection, governance, risk management, and business ethics. The findings indicate that MHES theses generally focus on regulatory studies, policy implementation, supervision, evaluation, and dispute resolution within both bank and non-bank Islamic financial institutions, while also addressing emerging issues in Islamic economics. These findings highlight the importance of curriculum renewal to ensure its continued relevance to industry needs and contemporary business developments. Efforts that should be undertaken include designing a curriculum based on graduate user needs and incorporating additional subjects such as Islamic financial dispute law, Islamic bankruptcy law, digital transactions, cyber law and customer data protection, as well as global and international trade.
