Abstract

The development of social media in the digital era influences family life, both as a means of communication and as a potential source of conflict between spouses. This study aims to analyze divorce related to social media from the perspective of Islamic Family Law through Decision Number 00XX/Pdt.G/2021/PA.Adl of the Andoolo Religious Court, South Konawe Regency, Southeast Sulawesi. It addresses two research questions concerning the judge’s considerations regarding social media and the Islamic Family Law perspective on those considerations. This study employs library research using a normative juridical approach by analyzing court decisions, legislation, the Compilation of Islamic Law, books, and scientific journals. The findings indicate that the judge granted the divorce petition based on continuous disputes and quarrels, separate residences, and unsuccessful reconciliation efforts. Social media was raised by the petitioner as one of the issues; however, witness testimony did not directly establish it as the cause of the disputes. From the perspective of Islamic Family Law, the judge’s considerations are consistent with the principles of fiqh munakahat and the Compilation of Islamic Law concerning divorce due to prolonged, irreconcilable disputes. Therefore, the divorce was granted based on the marital circumstances and applicable legal grounds, rather than social media use alone.
